According to the suit, the Dilbar dancer recorded videos inside a Cessna Citation CJ2 aircraft during a Mumbai-Jaipur Flight in December last year. In the videos she posted on her Instagram handle, the actor described the aircraft as a ‘miniature’, a ‘toy’, and a ‘Lego Airplane’.

Defamation Suit, Company’s Claims

Dunes Aviation has alleged that Nora Fatehi’s “reckless” statements, given her social media following of more than 4.6 crore, triggered booking cancellations and caused more serious damage to its business. The company claimed that its bookings dropped by 15-20 per cent, while cancellations increased following the actor’s remarks.

The suit was filed in April this year and claimed that the actor Fatehi’s comments were ‘’reckless, irresponsible, and made without any technical knowledge, verification or factual basis’’.

Dunes Aviation further said that the actor’s substantial follower base amplified the impact of her remarks, resulting in serious reputational damage, loss of goodwill, and adverse commercial impact for the company.

The aviation firm has alleged that the posts caused reputational and commercial damage, including booking cancellations and a decline in business. According to the company, its bookings dropped by 15 to 20 per cent following the controversy, while cancellations increased.

The company has stated that the aircraft was fully DGCA-certified and airworthy and was being operated legally under a valid Non-Scheduled Operator’s Permit (NSOP).

Apart from seeking Rs 3 crore in damages, Dunes Aviation has also sought directions from the court for the immediate removal of all social media content containing the statement or references to the aircraft.
